Clear terms for SmartBookmarks.

These terms govern SmartBookmarks and its optional Nexamas account and Cloud Vault services without reducing mandatory consumer or data-protection rights.

1. Service

SmartBookmarks provides a local-first bookmark and browser-session library. Local functionality does not require a Nexamas account. Optional account features include authentication, trusted-device/session management and encrypted synchronization through Nexamas Cloud Vault.

2. Account and sign-in

You are responsible for access to your verified email account and third-party identity-provider accounts you choose to use. Email-code, Google and Microsoft sign-in methods may be offered. Google and Microsoft act as identity providers, not SmartBookmarks storage providers.

3. Cloud Vault and encryption

When Cloud Vault synchronization is enabled, the extension encrypts the library before upload. Nexamas stores the encrypted Vault object and a wrapped Vault data key. The key model is Nexamas-managed and is not a zero-knowledge model. No separate user-held recovery secret is required.

You should keep an independent export/backup of important data. Although SmartBookmarks includes recovery and integrity protections, no software or network service can guarantee uninterrupted availability or absolute prevention of data loss.

4. Acceptable use

Do not use the service to attack, abuse, overload or circumvent security controls; to interfere with other users; or for unlawful activity. Automated abusive account creation or attempts to defeat authentication/rate limits may be blocked.

5. Third-party services

Optional features rely on third-party infrastructure and identity/email providers. Availability of those features can depend on those providers. Their own terms and privacy notices may also apply to their services.

6. Account deletion

You may delete the Nexamas account from SmartBookmarks. This removes the server-side account and Cloud Vault data according to the deletion workflow. Deleting the Nexamas account does not intentionally delete the local SmartBookmarks library from your browser.

7. Changes and availability

Nexamas may update SmartBookmarks to improve security, compatibility and functionality. Material changes to data practices will be disclosed as required. Features may change or be discontinued with reasonable notice where feasible, subject to legal obligations and urgent security needs.

9. Governing mandatory rights

Nothing in these terms limits consumer or data-protection rights that cannot legally be excluded. The legally responsible provider and jurisdictional information are stated in the Nexamas Imprint and applicable mandatory law.

SmartBookmarks ist eine Local-first-Bibliothek für Lesezeichen und Browser-Sitzungen. Lokale Funktionen benötigen kein Nexamas-Konto. Optionale Kontofunktionen umfassen Anmeldung, Geräte-/Sitzungsverwaltung und verschlüsselte Synchronisierung über Nexamas Cloud Vault.

2. Konto und Anmeldung

Sie sind für den Zugang zu Ihrer verifizierten E-Mail und zu optional verwendeten Drittanbieter-Identitätskonten verantwortlich. Google und Microsoft sind Anmeldeanbieter und keine SmartBookmarks-Speicheranbieter.

3. Cloud Vault und Verschlüsselung

Bei aktivierter Synchronisierung verschlüsselt die Erweiterung die Bibliothek vor dem Upload. Nexamas speichert das verschlüsselte Vault-Objekt und einen wrapped Vault key. Das Schlüsselmodell wird von Nexamas verwaltet und ist kein vollständiges Zero-Knowledge-Modell. Ein separates, vom Nutzer aufzubewahrendes Wiederherstellungsgeheimnis ist nicht erforderlich.

Für wichtige Daten sollten Sie zusätzlich einen eigenen Export/eine eigene Sicherung aufbewahren. Kein Software- oder Netzwerkdienst kann absolute Verfügbarkeit oder den vollständigen Ausschluss von Datenverlust garantieren.

4. Zulässige Nutzung

Der Dienst darf nicht für Angriffe, Missbrauch, Umgehung von Sicherheitsmaßnahmen, Beeinträchtigung anderer Nutzer oder rechtswidrige Zwecke verwendet werden. Missbräuchliche automatisierte Kontenerstellung oder Umgehung von Rate Limits kann blockiert werden.

5. Drittanbieter

Optionale Funktionen nutzen externe Infrastruktur-, Identitäts- und E-Mail-Dienste. Deren Verfügbarkeit und eigene Bedingungen/Datenschutzhinweise können zusätzlich gelten.

6. Kontolöschung

Das Nexamas-Konto kann in SmartBookmarks gelöscht werden. Dabei werden serverseitige Konto- und Cloud-Vault-Daten nach dem Löschworkflow entfernt. Die lokale SmartBookmarks-Bibliothek im Browser wird dadurch nicht absichtlich gelöscht.

7. Änderungen/Verfügbarkeit

Nexamas kann SmartBookmarks aus Sicherheits-, Kompatibilitäts- und Funktionsgründen aktualisieren. Wesentliche Änderungen der Datenpraxis werden entsprechend den geltenden Anforderungen offengelegt.

9. Zwingende Rechte

Zwingende Verbraucher- und Datenschutzrechte werden durch diese Bedingungen nicht eingeschränkt. Anbieter- und Rechtsangaben ergeben sich aus dem Nexamas-Impressum und dem anwendbaren zwingenden Recht.
